If for any reason a claim proceeds in court rather than in arbitration, both you and Hangry Joe's waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may bring an individual action in small claims court in the applicable jurisdiction, provided the claim qualifies under the rules of that court.

In the event of a force majeure occurrence, Hangry Joe's will use commercially reasonable efforts to resume normal operations as quickly as practicable. We will notify affected customers of any material service disruptions caused by force majeure events where reasonably feasible.

The parties agree that in the event a provision is found to be unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, preserving the original intent of the parties to the greatest extent possible.
